Apple: Sale of iPhones without a charger is suspended by the Court

On Tuesday (6), the Court ordered the suspension of sales of iPhones without a charger. It also fined Apple R$ 12 million. The decision was published in the Official Gazette of the Union (DOU).

The court's decision

The Ministry of Justice decided that it would not apply the daily fine unless Apple suspended sales of devices without a charger. Therefore, if it is proven that the company did not comply with the prohibition, the penalty will be applied later.

Apple iPhones being sold without the charger

In October 2020, after announcing the new iPhone 12, Apple stopped including the plug adapter in all its devices, claiming that the decision integrated its environmental objectives. 

In January 2021, on Apple's initiative, Samsung decided not to include the wall charger and headphones, offering only the device with the USB cable.

With this, Samsung justified that selling the device without a charger and headphones serves environmental purposes, the same justification used by Apple. On that occasion, Samsung made available to consumers the option to redeem the charger via the “Samsung for you” page.

In October 2021, the Ministry of Justice and Public Security notified Apple and Samsung for not following instructions to justify the lack of chargers in the devices.

Thus, in May 2022, the National Consumer Secretariat (Senacon), which is part of the Ministry of Justice and Public Security, provided instructions to more than 900 Procon entities in Brazil to initiate administrative proceedings against Apple and Samsung for the sale of wireless devices. the charger.

Finally, in August this year, the new Galaxy Z Flip 4 and Z Fold 4 phones returned with chargers. However, for other models, such as the Galaxy S22, the accessory must still be ordered via the Samsung website.
