Today, Wednesday 1st, the deadline for employees born in the month of February to request the withdrawal of the FGTS 2023 Birthday Withdrawal amounts began. Faced with several controversies regarding the end of the modality, the birthday withdrawal reached a record number of rescues in January and should continue to be sought by workers in the second month of 2023.

How does the FGTS birthday withdrawal work?

1. Is withdrawal optional?

Firstly, the FGTS Birthday Withdrawal is an optional modality, that is, the employee is not obliged to opt for the annual withdrawal of resources from the Guarantee Fund. The standard FGTS withdrawal system is Withdrawal-Termination, a modality in which the worker has the right to withdraw the full amount from the Fund if they are fired without just cause.

2. Disadvantages of the birthday withdrawal

Before opting for the modality, it is important to remember that there are some differences that may make the withdrawal not so advantageous. For example, when choosing the birthday withdrawal, the employee loses the right to withdraw the entire amount available in the Guarantee Fund – a right guaranteed by the termination withdrawal, as mentioned above.

Another disadvantage is that if the worker regrets opting for the birthday withdrawal, he must remain in the modality for a period of 2 years until the return to the termination withdrawal is authorized.

3. Deadline for withdrawal of 3 months

The employee can request the birthday withdrawal at any time of the year. However, to receive the money within the current year, the deadline for requesting is from the first to the last business day of the month of birth.

The deadline for withdrawing funds from the account is slightly longer: the worker will have from the first business day of the birthday month to the last business day of the second subsequent month to make the withdrawal.

What is the value of the FGTS birthday withdrawal?

The value of the birthday withdrawal is calculated based on a Caixa Econômica table that takes into account the FGTS account balance, a withdrawal rate and an additional installment, check below:

For example: A worker who has R$ 1 thousand in the FGTS can receive from the Birthday Withdrawal the value of R$ 400.00 (rate of 40%) plus R$ 50.00 (additional installment), totaling the value of R$ 450.00.

It is also possible to simulate the amount available for the birthday withdrawal by accessing the FGTS App, selecting the option “FGTS birthday withdrawal” and clicking “Simulate the value of the Birthday Withdrawal“.

Is it possible to withdraw from the birthday withdrawal?

If the worker chooses not to withdraw another part of the balance annually, the birthday withdrawal can be undone through the FGTS app (available for Android and iOS) or through the Caixa website at https://www.fgts. gov.br.

Will birthday loot really end?

Yes, it is true that the FGTS anniversary withdrawal could be extinguished under Lula's government. Recently, Luiz Marinho, Minister of Labor, said that from March onwards, new requests for birthday withdrawals will no longer be accepted.

However, Marinho guaranteed that those who have already signed up to the withdrawal modality will not have any changes to their contract. “We must put an end to this birthday withdrawal format. For existing contracts, we will not distort“, said the minister during an interview with GloboNews.

I opted for the birthday withdrawal and was fired, can I withdraw the FGTS?

As mentioned above, when opting for the birthday withdrawal there are some changes to the rights that the worker has in the event of dismissal. If the person opting for the birthday withdrawal is fired, even without just cause, they will not have the right to withdraw the full amount from the Guarantee Fund, as happens in the FGTS withdrawal-termination modality.

Other rights, such as the termination fine of 40%, accrued vacation, salary balance and proportional 13th salary remain valid. The worker who opts for the birthday withdrawal will also be able to receive unemployment insurance in the event of dismissal.

Is it possible to bring forward the birthday withdrawal?

Yes, it is possible to advance up to 5 installments of the Birthday Withdrawal via the FGTS App. The modality works as a form of loan with an interest charge of 1.49% per month.

However, not everyone can advance the birthday withdrawal loan. The bank stipulates a minimum of R$ 500.00 for this type of loan and it is mandatory that each advance installment is equal to or greater than R$ 200.00.

The requirements to anticipate the FGTS birthday withdrawal are:

  • Be over 18 years old or emancipated;
  • Have a current account at CAIXA;
  • Have opted for the FGTS birthday withdrawal and Authorize CAIXA to consult information about your FGTS;
  • Have a sufficient FGTS balance for advance payments within the minimum contractual amounts;
  • Have a CPF in good standing with the Federal Revenue Service;
  • Be in good standing with Caixa or use credit resources to pay off the debt.

The employee can opt for a birthday withdrawal between the 1st day and the last working day of the month of birth and withdraw the amounts during the current year. If this deadline is missed, it will be possible to join the modality, but the withdrawal of resources will only be released the following year.

  • Born names of February - withdrawal available from February 1st to April 28th
  • Born names of March - withdrawal available from March 1st to May 31st
  • Born names of April – withdrawal available from April 3rd to June 30th
  • Born names of May - withdrawal available from May 2nd to July 28th
  • Born names of June - withdrawal available from June 1st to August 31st
  • Born names of July - withdrawal available from July 3rd to September 29th
  • Born names of August - withdrawal available from August 1st to October 31st
  • Born names of September - withdrawal available from September 1st to November 30th
  • Born names of October - withdrawal available from October 2nd to December 29th
  • Born names of November - Withdrawal available from November 1st to January 31st, 2024
  • Born names of December - withdrawal available from December 1st to February 29th, 2024
