FGTS: Those born in December can now request a birthday withdrawal

In short, the benefit is available for 3 months from the 1st business day of the employee's birthday month. That is, until the end of January. In addition, the FGTS birthday withdrawal is also available to those born in October and November.
Since its launch in April 2020, the FGTS birthday withdrawal has been used by more than 21 million employees. And so, it has already injected more than R$ 31 billion into the economy. Migration to the modality is optional and must be communicated to Caixa. When opting for this modality, the worker withdraws, every year, part of the balance available in the FGTS account.
The FGTS birthday withdrawal was established by Law 13,932/19 and allows the employee to withdraw part of the balance from active and inactive FGTS accounts. Withdrawal is available from the month of your birthday.
The birthday withdrawal was created to give employees a new way to withdraw their balance. In this modality, depending on the month of birth, the employee can withdraw part of the value of the FGTS accounts per year, in the month of their birth.
For those who adhere to this modality, the person loses the right to withdraw the total balance from the FGTS account, in the event of unfair dismissal. In this case, the worker can only withdraw the fine of 40% of the FGTS amount.
Therefore, the birthday withdrawal will only be released to employees who inform Caixa that they wish to receive the amounts annually. Otherwise, he will only be able to withdraw the FGTS in cases provided for by law, such as for the purchase of his own home, retirement and unfair dismissal.
Furthermore, the request must be formalized by the last day of the birthday month. Otherwise, the employee will be entitled to the annual installment of the FGTS birthday withdrawal only in the following year.
Birthday withdrawal x Termination withdrawal
Those who do not opt for the birthday withdrawal continue with the standard withdrawal-termination modality. See the difference between the birthday withdrawal and the termination withdrawal:
Withdrawal-termination: In this modality, the employee, when fired without just cause, has access to a full withdrawal from the FGTS account, and the termination fine. This is the standard modality in which the employee joins the FGTS.
Birthday Loot: In this modality, in every month of their birthday, the employee can withdraw a percentage of the FGTS balance. And in cases of dismissal, the employee will have the right to withdraw only the amount relating to the termination fine (fine of 40% paid by the company), and will not be able to withdraw the full amount from the Fund.

FGTS birthday withdrawal limit value
The payment amount is a percentage of the employee's account balance. In this case, for accounts up to R$ 500, 50% will be released from the balance. For accounts above R$ 500, the withdrawal percentages are increased by a fixed installment. See the examples below:
- For those who have R$ 750 in their account: they can earn 40% of R$ 750. That is, R$ 300 + the additional rate of R$ 50, totaling R$ 350;
- For those who have R$ 25,000 in their account: they can earn 5% from R$ 25,000. In other words, R$ 1,250 + the additional rate of R$ 2,900, totaling R$ 4,150;
- For those who have R$ 100,000: you can earn 5% from R$ 100,000. In other words, R$ 5,000 + a tax rate of R$ 2,900, totaling R$ 7,900.
It is important to remember that when withdrawals are made, the balance reduces and the percentage to be withdrawn increases.
