INSS: Late payment can result in good money; R$ 1 billion is released

In January, the Federal Court released another batch of late INSS payments. The values refer to legal proceedings opened by policyholders against the Institute. When adding up all the shares, the payment of arrears amounts to R$ 1.12 billion.

Closed processes must have an estimated payment date for the year 2023. In other words, the INSS can no longer be able to request an appeal to the Court. It is also necessary to check that the amount charged does not exceed the value of 60 minimum wages.

After this, only late RPVs (Small Value Requests) must be paid. Small Value Requests are actions where a payment of up to 60 INSS minimum wages is requested (value of R$ 78,120.00). For payments made in 2023, the value considered is R$ 1,302 (current national floor value).

What are late payments?

When the beneficiary requests the INSS benefit, they do not always receive payments immediately. From this point on, the applicant has the right to receive these outstanding amounts.

The accumulated values are from the date of application, or from the date on which the requirements for the release of the INSS benefit were met. These delays lead to the payment of fines by the agency and monetary correction. 

In 2023, the INSS is expected to pay 58,000 outstanding cases.

Who informs when INSS arrears are released?

Your lawyer is the one who must keep you informed about the payment of past-due INSS amounts. And if your compensation is taking a long time to come out, don't worry. This is said because there is no possibility of you not receiving the amounts.

In short, the request is issued in the name of the applicant's CPF. Therefore, the lawyer, for example, cannot receive payment from the client without the client knowing.

The court where the action is judged is the one who defines the date for payment of late amounts. Each TRF (Federal Regional Court) has a calendar, and receives the transfer of an amount defined by the Federal Court, for the payment of requests.

Payments of late amounts are made to Caixa Econômica or Banco do Brasil accounts. The location of payments will also be defined by the court.

However, interested parties can consult individually by name or case number on the website of each Court (TRF) that involves certain states of jurisdiction.

What is the amount paid in RPV in each Court?

  • TRF of the 1st Region (DF, MG, GO, TO, MT, BA, PI, MA, PA, AM, AC, RR, RO and AP): pension RPVs of R$ 513 million (33 thousand beneficiaries) – Make the inquiry here;
  • TRF of the 2nd Region (RJ and ES): pension RPVs of R$ 101 million (5 thousand beneficiaries) – Make the inquiry here;
  • TRF of the 3rd Region (SP and MS): social security RPVs – R$ 249 million (7.6 thousand beneficiaries). Make the inquiry here;
  • TRF of the 4th Region (RS, PR and SC): social security RPVs – R$ 252 million (15.4 thousand beneficiaries). Make the inquiry here;
