INSS: 1 billion will be paid to retirees after the CJF decision

This is because the Federal Justice Council – CJF announced that the regional TRFs will pay R$ 1.37 billion in arrears to the institute's retirees. The average amount that each retiree will receive is R$ 10,899.00.
According to the agency, there will be 125,942 policyholders who will receive late payments. Of the total, R$ 1.2 billion will be allocated to processes relating to social security benefits, such as retirement, pensions, sickness benefits, and other benefits.
Policyholders who won the lawsuits and won the case will receive the amounts through Caixa Econômica or Banco do Brasil accounts, depending on the calendar of each TRF (There are a total of 5 in the country), who has administrative autonomy to make payments .
To find out whether they can receive the amounts and when the funds will be deposited into the account, the insured can contact the law firm responsible for the action or consult the website of the court where the procedure was conducted.
Who will receive the INSS arrears?
The INSS arrears are made available to those who filed a lawsuit against the local authority and won the case, with the payment order date set by the judge now starting in February 2023.
It is important to remember that only processes up to 60 minimum wages, called Small Value Requests (RPVs), pension reviews, death pension, sickness benefit and Continuous Payment Benefit (BPC) will be paid. The limit of 60 salaries already includes the update of the minimum wage, currently worth R$ 1,302, that is, shares of up to R$ 78,120.00.
Furthermore, it is still necessary for the action to have been closed, without the possibility of an appeal from the INSS, a situation in which there is a final and unappealable decision.
How to check the amount receivable?
For more information about the amounts you may be entitled to, the insured must consult the case by name of the party in the following courts, linked to the regions/states of:
- TRF of the 1st Region (DF, MG, GO, TO, MT, BA, PI, MA, PA, AM, AC, RR, RO and AP): pension RPVs of R$ 513 million (33 thousand beneficiaries) – Make the inquiry here;
- TRF of the 2nd Region (RJ and ES): pension RPVs of R$ 101 million (5 thousand beneficiaries) – Make the inquiry here;
- TRF of the 3rd Region (SP and MS): social security RPVs – R$ 249 million (7.6 thousand beneficiaries). Make the inquiry here;
- TRF of the 4th Region (RS, PR and SC): social security RPVs – R$ 252 million (15.4 thousand beneficiaries). Make the inquiry here;
- TRF of the 5th Region (PE, CE, AL, SE, RN and PB): social security RPVs – R$ 169 million (13 thousand beneficiaries). Make the inquiry here.

- 102,590 processes;
- 125,942 beneficiaries;
- Total value of R$ 1,372,713,180.04;
- Average amount to be received per beneficiary: R$ 10,899.00;
