INSS: The list of those who will receive R$ 25.4 billion in court has been released; check out

Retirees who won a case in court against the INSS will receive the amounts from the month of September. In total, the Federal Court will release R$ 25.4 billion to those who won their cases.

The president of the CFF (Federal Council of Justice), minister Humberto Martins, had already sent letters notifying the payments to the TRFs in each region of the country. After the recent creation of the TRF-6 of Minas Gerais, there will now be 6 Federal Regional Courts making payments across the country.

According to the minister, the transfer of resources will be done at the discretion of each TRF in accordance with the release of the Federal Court's Monthly Disbursement Schedule. The estimate from the Federal District and Territories of the Central-West and Northern States (TRF-1) predicts that these amounts will be paid during the first week of September.

Who receives the INSS precatory amounts?

Retirees, pensioners and INSS policyholders who went to court to request the review or granting of benefits will receive the amounts.

Payments would begin in August, but the CJF accepted a request from the Brazilian Bar Association (OAB) which requested payment of lawyers' fees in the same batch.

Initially, the TRFs would only pay policyholders for won cases, but legal fees were not credited to the account for payment this year. Now, in an extraordinary meeting, the CNJ informed the author and also the lawyers the value of the court orders.

Payments will be limited

There will now be a payment limit when paying attorney fees. Therefore, those who have more than 180 minimum wages to receive (R$ 218,160.00) will only receive the difference beyond this amount in 2023. 

This is because the resources sent by the federal government to pay court orders were limited to R$ 32.4 billion – R$ 25.4 billion for the Federal Court, which judges cases related to the INSS, in addition to an additional R$ 7 billion for other branches of the judiciary that judge other cases.

Payments take up to 2 months to make.

Consultation of INSS precatory values

For the insured who wants to know whether he will receive the outstanding amounts, it is necessary to check the status of the case through the websites of the Regional Courts of each region in which the case was judged, using the CPF number, legal action number or the OAB number of the attorney.

The query method may vary from portal to portal. Some TRFs only request the CPF and others may ask for more specific information such as the process number, for example.
