INSS medical expertise: Who can be exempt from this procedure?

Medical expertise is a procedure carried out by an INSS medical expert. The task of this professional is to identify if there is any illness or if there has been an accident that has prevented you totally or partially, temporarily or permanently, from carrying out your professional activities.

INSS medical expertise must be carried out when it is necessary to verify the possibility of granting, extending or interrupting the payment of a certain benefit.

However, not all beneficiaries are required to have a regular medical check-up, check it out!

Who needs to undergo the INSS medical examination?

Benefits that require expert scheduling:

  • Accident assistance;
  • Sickness benefit (temporary incapacity benefit);
  • Continuous Payment Benefit – BPC;
  • Disability retirement (permanent disability benefit);
  • People with a disability or serious illness who wish to receive a Death Pension. 

Who can be exempt from the expertise?

From the beginning of 2015, pensioners and retirees with disabilities will no longer be subject to expertise if they have reached 60 (sixty) years of age.

However, there are exceptions, such as:

  • Verify the need for permanent assistance from another person to grant the increase of 25% (twenty-five percent) on the value of the benefit, as provided in art. 45 of Law 8,213 of 1991
  • Verify the recovery of work capacity, upon request from the retiree or pensioner who is deemed fit;
  • Support judicial authority in granting guardianship, as provided for in art. 110, of Law 8,213/91.

Therefore, retirees and pensioners aged 60 or over who have some type of disability cannot undergo expert examination, except in the three cases mentioned above.

Social Security Decree No. 3,048 also establishes that insured persons between the ages of forty-five and fifteen, counting from the date of granting the disability pension, are exempt from a medical examination.

How do I schedule an INSS medical examination?

For those who do not meet the above requirements, they must make an appointment online. To schedule an INSS medical exam, you must follow the instructions below:

  • Access the INSS website or app (available for Android and iOS);
  • Click on “Schedule Expertise” 
  • Click on “New Application”;
  • Choose between “Initial Expertise” if it is the first time, or “Extension Expertise” if you have already received the benefit;
  • Follow the indicated guidelines;
  • Enter the details to complete your order.
