Last installment of the 13th salary must be paid by next week

In addition to workers with a formal contract, people who performed some work throughout the year are also entitled to the benefit, as well as temporary workers and people who took maternity or medical leave.

What to do if I don't receive the thirteenth?

If the worker has not received payment of the first installment of the 13th salary, he or she must contact the HR (Human Resources) department or the company's finance department and notify the incident. If the company still refuses to pay the rights, the professional must file a complaint with the MPT (Public Ministry of Labor) or the union of his category.

But if the worker made a request for an advance payment at the time of his vacation, he will then be entitled to receive only the second installment of the thirteenth salary, which must be made by December 20th.

Calculation of the 13th salary

The thirteenth salary is calculated considering the gross salary, without advances or deductions, based on the total remuneration, with overtime, hazard pay, commissions, tips and health hazard pay, if received.

Afterwards, the total monthly salary is divided by 12 (number of months in the year) and then the result is multiplied by the number of months worked. If the professional worked six months out of the year, he or she should receive half the amount, for example.

The first installment of the 13th salary pays 50% of the amount, without discounts. In the second installment, Income Tax and INSS amounts are deducted.

If the worker has taken sick leave, the company must pay in proportion to the time worked, with the first 15 days of absence, and the rest is the responsibility of the INSS. If the worker was on leave for the entire year, the 13th salary must be paid in full by the INSS.
