FGTS allows withdrawals from inactive accounts in 2022

The FGTS (Service Time Guarantee Fund) is a benefit paid by the employer to employees who carry out formal work, in accordance with the Consolidation of Labor Laws (CLT).

The fund can only be released for subscription in certain situations. Some of the amounts are also available to pay inactive accounts.

Normally, the fund is only released for use in certain situations, such as unjustified termination, retirement, serious illness or first purchase of residential property.

The FGTS account becomes inactive when the employee stops benefiting from 8% of the salary due to dismissal without just cause or resignation. However, it is important to highlight that interest and cash adjustments remain active when funds accumulate in this account.

Although the account is inactive, employees can redeem the amounts contained therein. To do this, the beneficiary simply accesses the Withdrawal due to Inactivity tab in the fund's system and continues with the procedure, either by transferring the funds to a bank account or making the payment in person at a branch.

Anyone who has an FGTS account that has been inactive for less than three years can withdraw in the following situations:

  • Serious diseases;
  • Dismissal without just cause;
  • retirement;
  • purchase of the first property;
  • debt payment;
  • Consensual termination between employee and employer;
  • If the company ceases its activities;
  • Termination of the contract due to force majeure;
  • In case of suspension longer than 90 days;
  • Death of the worker;
  • emergency situations or state of public calamity;
  • Birthday loot.
