FGTS: Minister confirms the END of the anniversary withdrawal in 2023

Last Sunday (12), the Minister of Labor and Employment, Luiz Marinho, participated in an interview with the Brasil em Pauta program on TV Brasil. On the occasion, the minister mentioned that it will be necessary to review the relationship between employer and employee and defended new social protection for Brazilian workers.
With this, Marinho stated that it is necessary to review what was harmed in this process of working relationships so that it is possible to return to the issue of negotiation, valuing the work itself, the wage bill, in addition to the generation of employment and income.
The Government's idea is to create several working groups with the participation of trade unions and businesspeople, adopting an intermediation process between the parties. Marinho also spoke about minimum wage and FGTS.
A new policy to increase the minimum wage
The minister stated that there will be a resumption of the policy of increasing the value of the national minimum wage. Therefore, the Government is still studying the possibility of fiscal space to carry out another increase this year, probably from May onwards. Therefore, in addition to the increase in January of 1.4% in the real increase, going from R$ 1,212 to R$ 1,302, the minimum wage intended by the PT government in this first year is R$ 1,320, symbolically to be announced on Labor Day.
The group formed to study the increase in the minimum wage is still discussing whether the GDP (Gross Domestic Product) of the last three years will be taken into account or whether it will be the consolidated GDP format, considering the last two years.
End of FGTS anniversary withdrawal this year
In the same interview, Marinho confirmed that he is in favor of ending the FGTS Anniversary Withdrawal, the Guarantee Fund for Length of Service. With this, the minister recalled that the FGTS was created in 1966 at the request of multinationals so that workers would have a type of savings linked in their name. Therefore, companies today pay a fine of 40% on the amount deposited at the time of unfair dismissal, and that is how it works.
Parallel to this, a fund was created for investment in housing and sanitation to generate jobs and housing protection with this retained money.
Between 2005 and 2007, a new modality was implemented which involved the creation of the FGTS investment fund itself, making it more powerful to finance more housing, more infrastructure and more sanitation and thus, improving profitability for the worker.
Thus, the FGTS withdrawal could be made in full at the time of dismissal (without just cause), when purchasing your own home or in the case of serious illnesses.
For him, the creation of the FGTS Anniversary Withdrawal by the previous government created two problems: one of them was the reduction in the fund's capacity for investment and the other was the issue of workers not being able to withdraw their amounts for two years after dismissal from a job, which It is the most necessary moment, even if you have a balance in your account.
Furthermore, the minister disputes the fact that the worker can anchor the loan with the FGTS Birthday Withdrawal. In this way, the bank charges interest, even though the person has the balance in the account but cannot use it.
The following situation was created for the worker: he went and joined, through advertising, Caixa does it, the bank does it, and can anchor the loan from the birthday withdrawal […] a dismissal ends up happening unexpectedly. He cannot withdraw his fund, and what was intended to protect him, he cannot activate it for two years, which is when he needs it. The greatest urgency he cannot take.
Marinho stated that this rule will change. The modality will be discussed in the coming weeks. For him, banks took advantage of workers' financial needs to raise money in favor of their interests.
